A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On December 30, 2016, when the Defendant engaged in a business related to the auction of real estate in the Co., Ltd., the Defendant: (a) commenced a compulsory auction on January 3, 2017, with respect to the real estate owned D located in Ansan-gu C at the time of Ansan-si; (b) on July 6, 2017, upon the request of the creditor E, proposed that I, who is the Defendant’s seat, bid for the auction of the said real estate after being aware that the voluntary auction procedure (H) occurred at the request of the creditor G Union; and (c) on October 19, 2017, the said I bid for the said auction and proposed that I will buy the said real estate at the auction. On October 19, 2017, the highest price of the said real estate (goods No. 7,8,10,11,13) was determined as the purchaser.

On November 2017, when the Defendant came to know of the fact that the said I had to return money to the lessee with respect to the goods 13 out of the goods awarded a successful bid as above, the Defendant prepared a lien report, construction work contract, etc. by stealing the name of “J” that was previously known in the course of other businesses, and forged it, and did not possess any construction work claim as to the said D as to the said real estate because it did not have any construction work claim as to the said real estate, but did not possess the said real estate, despite the fact that the said I did not possess any construction work claim as to the said D, the Defendant was willing to interfere with the said auction by asserting a false claim for construction work payment based on the forged document, and
