1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On April 30, 2004, the Plaintiff and New Construction Co., Ltd. (hereinafter “New Construction Co., Ltd.”) related to the Plaintiff and New Construction Co., Ltd. (hereinafter “New Construction Co., Ltd.”) are land B, C, and D (hereinafter “instant apartment site”) from the petitioner Gun.
3) On the ground, the Plaintiff obtained the approval of the housing construction project aimed at constructing the instant apartment on the ground (hereinafter “the instant business right”).
(2) On June 19, 2005, the Plaintiff entered into a contract for the transfer and acquisition of the instant apartment site with respect to new construction as a contractor of the instant housing construction project, the instant business right, and the instant apartment site ownership, with respect to the acquisition of all obligations related to the instant housing construction project, and payment of KRW 335,00,000 to the Plaintiff, and completed the registration of ownership transfer on the instant apartment site for the new construction on June 18, 2005, and obtained a modified approval of the business plan from the petitioner-gun to the Plaintiff from the new construction on July 19, 2005.
B. On February 15, 2006, Defendant New Construction Co., Ltd. (hereinafter “Co., Ltd.”)’s relationship with Defendant New Construction Co., Ltd. (hereinafter “Co. (hereinafter “Co., Ltd.”) is based on a transfer agreement with the following terms: (a) on February 15, 2006, Defendant New Construction Co., Ltd. (hereinafter “Co., Ltd.”) to undertake the obligation of KRW 1,610,000,000, including the principal and interest of a new construction; and (b) on the instant business right and ownership of the instant apartment site; and (c) to pay KRW 150,00,000 for the remainder of new construction (hereinafter “the first transfer agreement”).
After the conclusion of the contract, the name of the owner of the apartment building in this case was changed to the development of the virtue industry, and the provisional registration was completed with respect to the apartment site in this case. (2) However, the development of the virtue industry did not take over the principal and interest of the loan pursuant to the first transfer contract and pay the balance.
