A defendant shall be punished by imprisonment for a term of one year and two months.
Reasons
Punishment of the crime
The defendant of "2014 Highest 2517" was urged to pay a debt amounting to approximately KRW 700 million to the creditors around 2006. Thus, even if he/she borrowed the money to the victims, he/she did not have the intent or ability to pay the said money. Even if he/she received the payment from the victims and operated the fraternity, he/she was willing to use the said payment to repay the said debt, and the defendant did not have the intent or ability to pay the money to the victims.
1. relating to the fraud of the fraternity;
A. On July 5, 2007, the Defendant: (a) made a false statement that the Defendant would provide the victim C with the number fraternity at a mutually unclaimed restaurant located in the corrected Manam-si, Seongbuk-do; and (b) received a total of KRW 17 million from the victim to November 5, 2008, from November 5, 2008, a sum of 17 million from the victim under the name of relay payment, as shown in the attached list 1 of the crimes committed in the above restaurant, etc. from the victim to the victim.

On June 28, 2008, the defendant made a false statement that the defendant would pay the money to the victim F if he/she joins the number system at a cafeteria with the mutual unclaimed cafeteria which is located in the margu Manam-si, Sungnam-do.
