Punishment of the crime

The Defendant introduced himself/herself as a business director of D, a company that received health functional foods, and entered into a product supply contract with D, and sells “C”, thereby making a tour in the local center of E, a multi-level sales chain company that sells “C”.

No one shall indicate or advertise that the name, raw materials, manufacturing methods, dietitians, ingredients, methods of use, quality, and traceability of functional health foods has efficacy in preventing and treating diseases, or is likely to mislead or confuse such diseases as medicine.

그럼에도 피고인은 2015. 4. 초순경 전주시 완산구 F에 있는 위 회사 전주센터 사무실에서 회원 G 등에게 'C'를 소개하면서 “이 제품을 3일만 먹으면 전립선이 낫고, 하룻밤에 2~3회 성관계를 가질 수 있을 정도로 효능이 좋다. 암 환자도 3개월만 복용하면 나을 수 있다. 다른 여러 가지 질병에도 효험이 있다.”라는 취지로 강연한 것을 비롯하여, 2014. 10.경부터 2015. 5.경까지 별지 범죄일람표 기재와 같이 총 71회에 걸쳐 회원들을 상대로 ‘스탐플렉스’에 관하여 위와 같이 질병의 예방 및 치료에 효능ㆍ효과가 있거나 의약품으로 오인ㆍ혼동할 우려가 있는 내용의 광고를 하였다.
