Defendants shall be punished by imprisonment for six months.

Punishment of the crime
Defendant
A is the husband of Guri-si, C and D’s land owner E, and on February 18, 2016, after obtaining a building permit for one of the storage units of agricultural products with a total floor area of a total floor area of 500 square meters on the above land, etc., and obtaining approval for the use of the above building on April 28, 2016, and Defendant B is the actual owner of the building, and Defendant B is the person in charge of the household distribution company, “F.”
No act of constructing buildings, altering the purpose of use, installing structures, changing the form and quality of land, cutting bamboo and trees, dividing land, piling-up goods, etc. shall be allowed in a zone subject to development restriction.
Provided, That where constructing buildings or installing structures prescribed by Presidential Decree and changing the form and quality of land is conducted for the residential, living convenience and livelihood of residents of a development-restricted zone, permission from the head of a Si/Gun/Gu shall be obtained.
1. On December 2, 2016, Defendant A and Defendant B, a joint crime (unauthorized change of use) committed by Defendant A and Defendant B, changed the purpose of use by converting the storage of agricultural products 289.92 square meters, which were constructed with permission from Guri-si, a development restriction zone, into a house distribution warehouse and office, unlike the original permitted purpose. Defendant B leased the said warehouse from A, and used the said warehouse as a house distribution store and warehouse.
As a result, the Defendants conspired to change the use of the building in the development restriction zone without obtaining permission from the competent authorities.
2. Defendant A (construction of an unauthorized building) without obtaining permission from the competent authority, and on December 2, 2016, the Gyeonggi-gu, Gyeonggi-si, a Gyeonggi-do, a development restriction zone, newly constructed a house distribution plant of approximately 300 square meters with a general steel structure, and constructed a building.
