1. The Defendants jointly share KRW 12,700,726 with respect to the Plaintiff, and the period from April 29, 2016 to November 15, 2017.
Reasons
1. Facts of recognition;
A. Defendant B is a licensed real estate agent of “D Licensed Real Estate Agent Office,” and Defendant C is a licensed real estate agent of “E Licensed Real Estate Agent Office.”
B. On February 14, 2015, the Plaintiff entered into a lease agreement with G, the owner of the land and the 4th floor of the land (hereinafter referred to as “the instant multi-family house”) in Suwon-gu, Suwon-si, the commission of the Defendants, with respect to the instant multi-family house 304 (hereinafter referred to as “instant house”) (hereinafter referred to as “the instant house”), under which the lease deposit is KRW 60,000,000, and from March 1, 2015 to February 28, 2017 (hereinafter referred to as “the instant lease agreement”), and completed the move-in report by March 30, 2015, the Plaintiff obtained the fixed date on the said lease agreement from February 17, 2015, and paid KRW 60,000,000,000 to G by March 2, 2015.
C. The confirmation and explanatory note of the object of brokerage prepared and delivered by the Defendants to the Plaintiff at the time of entering into the instant lease agreement includes “right matters other than ownership” in the column of “right matters other than ownership”, and the “right matters of the object that are not actual relation of rights or publicly notified” is indicated in the column of “right matters of the object” in the “right matters of the object of brokerage, 14 households, 50 million won of deposit, and 2 households of monthly rent,” and the “information on the state of the object” in the explanatory document is indicated as the “leased, 140 million won of deposit, 50 million won of monthly rent, and 200”.
However, at the time when the Plaintiff entered into the instant lease agreement, 14 lessees entered into the lease agreement with respect to the instant multi-family house, and the total amount of the deposit was KRW 937,00,000.
E. On February 11, 2015, G entered into a sales contract for the instant multi-family house with the Brazil Co., Ltd. (hereinafter “Nonindicted Company”). On February 24, 2015, Nonparty Company entered into the instant multi-family house.
