1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On August 6, 2015, the Defendant filed a claim 1 through 5, and 13 of the instant patent invention against the Plaintiff on August 6, 2015 (hereinafter “ordinary technician”) with the Plaintiff having ordinary knowledge in the technical field to which the invention pertains.
(2) On January 18, 2016, the Plaintiff filed a request for correction of the claim 1 of the instant patent invention with the Intellectual Property Trial and Appeal Board (hereinafter referred to as “instant Claim 1” and the remainder of the claims are referred to as “the instant correction invention” and the same method), and on February 19, 2016, the Plaintiff revised the instant correction request on February 19, 2016.
3) On February 29, 2016, the Korean Intellectual Property Trial and Appeal Board recognized the Plaintiff’s request for correction, but it is not allowed to amend the instant request for correction. The instant request for correction was rendered by the Defendant on the ground that the nonobviousness of the nonobviousness is denied and its registration should be invalidated, on the grounds that the correction invention under Articles 1 through 5, and 13 (13) of the instant case can easily be made by a person with ordinary skills from prior inventions 1 through 3.
