1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On April 17, 2007, the Plaintiff entered into a basic agreement on a youth hostel inducement project with the Defendant on April 17, 2007, concluding a basic agreement on the youth hostel inducement project, which constructs a youth hostel on the land outside 1065-14 and six parcels (hereinafter “instant land”).
B. On August 17, 2011, the Plaintiff: (a) on the ground of the instant land from the Defendant, the training facility with the name “inland youth hostel” (hereinafter “in the instant youth hostel”) in the name of “inland youth hostel” (hereinafter “in the instant case”).

(2) On July 12, 2012, the Plaintiff filed an application for the cancellation of the construction permit under Article 11(7)1 of the Building Act on August 20, 2012, on the ground that the Plaintiff did not start the construction work of the instant youth hostel more than one year after the instant construction permit. On July 30, 2012, the Defendant requested the Plaintiff to cancel the construction permit if the building was not commenced within one year from the date the construction permit was granted, and the Plaintiff again notified the Plaintiff that the construction permit would be canceled under Article 11(7)1 of the Building Act if the Plaintiff did not comply with the request. (2) On August 20, 2012, the Plaintiff filed an application for postponement of the construction permit of the instant youth hostel on the ground of the economic distress of the head office’s capital, and on September 12, 2012, the Defendant accepted the scheduled extension of the construction permit to the Plaintiff on August 15, 2013.
3. On August 12, 2013, the Defendant issued a provisional notice to the Plaintiff on the date of commencement, and on September 13, 2013, within one year from the date of receipt of the construction permit under Article 11(7) of the Building Act.
