Punishment of the crime

1. On June 21, 2012, the Defendant posted a letter to the effect that the Defendant sold a “outward” on the Internet Nuribber Cafster bulletin board “D” at the PC room located in Seocheon-si, Seocheon-gu, Seocheon-si, Seocheon-gu, Seoul, and talked that the Defendant sold the outsideboard that the Defendant had on the part of the victim.
However, as the defendant did not possess a ladrid, the defendant did not intend to sell it to the victim.
As above, the Defendant, by deceiving the victim, received 35,000 won from the victim to the Japanese bank account under the name of the Defendant on the same day.
2. On June 24, 2012, the Defendant, from the PC bank as indicated in paragraph (1) on June 24, 2012, by deceiving the victim as if he were to sell the external humd to the victim by means of paragraph (1), and then by deceiving the victim to transfer KRW 33,00 from the victim to the Japanese bank account in the name of the Defendant on the same day.
3. On June 26, 2012, the Defendant: (a) by deceiving the victim as if he/she sold a mobile phone to the victim by means of paragraph (1) from the PC bank as stated in paragraph (1) of this Article; and (b) by deceiving the victim from selling the mobile phone to the Japanese bank account in the name of the Defendant on the same day; and (c) by deceiving the victim.
4. On June 26, 2012, the Defendant: (a) by deceiving the victim as if he/she sold a mobile phone to the victim by means of paragraph (1) from the PC bank as stated in paragraph (1) of this Article; and (b) by deceiving the victim from selling the mobile phone to the Japanese bank account in the name of the Defendant on the same day; and (c) by deceiving the victim.
[2013 Highest 2766] On September 9, 2012, the Defendant posted a letter to the effect that “D sells mobile phones” on the Internet NAVV A bulletin board “D” at the PC located near Bupyeong-dong, Bupyeong-gu, Incheon, Bupyeong-gu, and completed the service to the victim AE who reported and contacted.
