1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. The Plaintiff is a licensed real estate agent who runs real estate brokerage business under the name of “C Licensed Real Estate Agent Office” in Yongsan-gu Seoul Metropolitan Government.
B. On March 18, 2017, the Plaintiff arranged a real estate lease agreement (hereinafter “instant lease agreement”) for the lease of part of the branch floor (hereinafter “instant leased object”) among the first floor underground and third floor buildings (hereinafter “instant building”) in Yongsan-gu Seoul Special Metropolitan City’s land-based multi-household concrete structure multi-family housing (six households) and the third floor building (hereinafter “instant building”) with D’s agent (F), and signed and sealed the agreement as a broker (hereinafter “instant lease agreement”).
The Plaintiff indicated as follows in the “mark of real estate” portion concerning the leased object of the instant lease agreement.
The land area of 59.4 square meters in the area of 59.4 square meters in the area of 461.88 square meters in the building structure, use of reinforced concrete structure, neighborhood living facilities, and residential area of 461.8 square meters in the lot of Yongsan-gu Seoul Metropolitan Government land category of Yongsan-gu G
C. On March 18, 2017, “the description of the object of brokerage” prepared as the instant lease agreement and delivered by the Plaintiff to the brokerage client is indicated as “the indication of the object: 59.4m2, “the purpose of use on the building ledger: Native living facilities and housing”, “the purpose of use on the building ledger”, “the neighborhood living facilities and housing”, “the legitimate purpose of use on the building ledger”, and “the document of confirmation” in the “written explanation of confirmation: A certificate of confirmation, etc.: a certificate of registration, a certificate of registration, land cadastre, building ledger, cadastral map, and written confirmation of land use.”
According to the building ledger of this case, the use and area of the instant building are “42.63 square meters in parking lots, general restaurants, 39.78 square meters in offices, 30.51 square meters in offices,” and the single floor is “12.92 square meters in houses (two households), 2, and 3 square meters in each house (two households).”
