1. The part against Defendant D in the judgment of the first instance is revoked.
2. All of the plaintiffs' claims against Defendant D.
Reasons
1. Basic facts
A. Defendant C is the mother of Defendant D, and the Defendants are the mother and mother.
B. As to the land of this case, the ownership transfer registration was completed on April 6, 1991 under the name of Defendant C, the husband of Defendant C and the father of Defendant D, for sale on April 4, 1991; the ownership transfer registration was made on November 15, 200; the ownership transfer registration was completed on March 1, 2001 as Defendant D on April 24, 2001 due to sale on March 1, 2001; and the ownership transfer registration was completed on November 27, 201 as to one-half portion of each of the land of this case on November 27, 2015.
C. On the land of this case, there are 4 m20 m2 (hereinafter collectively referred to as “the instant ground property”) in the ship that connects each point of 9,10, 11, 12, and 9 with the indication of the attached drawing(s) and 13, 14, 15, 16, and 13 with the indication of the same drawing(s) on the part of “14 m2” (hereinafter collectively referred to as “2”) in the ship which patrols each point of 814 m20,000 in the same drawing(s) and 17, 18, 19, 20, 20, and 17 of the same drawing(s).
Around September 9, 2005, Defendant C completed the registration of livestock breeding business by making the trade name Fyang, the location of which the instant land is located, Cheongju-gu E. The registration of livestock breeding business was completed.
E. On February 1, 2002, Defendant D completed the business registration for the wholesale business of electricity and telecommunications materials, with the name and location of Defendant D as “K in the Chungcheongbuk-gun.”
F. In the L voluntarily auction procedure of this court where the plaintiffs acquired the ownership of the land of this case, the instant fraternity was investigated into a building other than that set forth in Defendant D’s ownership, and the value as of June 3, 2014 was assessed to be 22,560,000, but was excluded from the subject of sale thereafter.
G. The actual survey area of the instant land is 5051 square meters, and is from November 27, 2015 to October 2016.
