Reasons
Punishment of the crime
Defendant, B, C, D, and E have intentionally caused a traffic accident using sirens, and they have caused damage to a passenger car and caused it, and they have received insurance proceeds under the pretext of agreement, etc. from an insurance company. However, the Defendant planned the method of committing the crime, and conspired to take charge of each of the roles of the Defendant, B, C, D, and E, by intentionally boarding the said sirens and causing an accident.
After the Defendant, B, C, D, and E set a FK5 car, on September 29, 2017, around 19:35, the two-lanes of the HH station located in Suwon-gu G, Busan, the two-lanes of the three-lanes in front of the HH station located in Suwon-gu, Busan, were found to have changed the course from the three-lanes to the two-lanes on the network-based surface, and the said K5 vehicle was caused by a traffic accident where the left-hand part of the said K5 vehicle was intentionally received on the right-hand side.
Then, the defendant, B, D, and E, at the scene of the accident, told the victim company by allowing the above K5 car to be damaged due to the above traffic accident and the defendant, B, D, and E to receive the insurance accident from the defendant, and they received the victim company as the total of KRW 312,200,00 in the name of the victim company to receive the insurance accident from the victim company, KRW 1490,00 in the name of the agreement, KRW 4,302,200 in the name of the vehicle repair expenses, KRW 1490,00 in the name of the vehicle repair expenses, KRW 252,750 in the name of the victim company, KRW 1,742,750 in the name of the medical treatment expenses, KRW 1492,750 in the name of the victim company, KRW 312,200 in the name of the treatment expenses, KRW 1,802,200 in the name of the treatment expenses, KRW 974,9794.74.700.
