A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the victim C (71) and the victim D (68 years of age) and the husband and wife.

피고인은 2013. 8. 2. 18:55경 서울 동대문구 E 피해자들의 집에서, 술을 마시고 귀가하였다가 주방 일을 하던 피해자 D이 피고인에게 아는 척을 하지 않았다는 이유로, 피해자 D에게 “씹할 년!”이라고 욕설을 하고, 머리채를 잡아 거실로 끌고 온 뒤 주먹으로 머리를 수 회 때리고, 발로 가슴과 배를 수 회 걷어찼다.

피고인은 계속하여 피해자 D의 머리채를 잡고 벽에 수 회 찧게 한 다음 싱크대 밑에서 위험한 물건인 부엌칼(전체 길이: 39cm. 칼날 길이: 24cm)을 꺼내 들고 피해자 D을 향해 겨누며 “찔러 죽인다!”라고 위협을 가하였다.

피고인은 이를 목격하고 있던 피해자 C으로부터 부엌칼을 빼앗기자, 피해자 D의 머리채를 잡아 거실벽, 쇼파 등에 수 회 찧게 한 다음 “씹할 년, 무릎 꿇고 빌어!”라고 말하여 피해자 D으로 하여금 바닥에 무릎을 꿇게 한 다음, 옆에서 이를 제지하던 피해자 C의 가슴을 주먹으로 수 회 때렸다.

Accordingly, the defendant, carrying dangerous articles, threatened the victim D, who is a lineal ascendant, added a scarcity, which requires treatment for about two weeks, and assaulted the victim C, who is a lineal ascendant.
