The defendant's appeal is dismissed.

1. The summary of the grounds for appeal did not inflict an injury on the victims as stated in the facts charged.

Even if the victims suffered injury due to the defendant's act, the defendant's act constitutes legitimate self-defense in response to the wrongful infringement of the victims.

2. In full view of the following circumstances that can be recognized by comprehensively taking account of the evidence duly adopted and examined by the court below and the court below, namely, ① the victims consistently made a statement to the effect that they correspond to the facts charged from the investigative agency to the court below, ② the status of photographs taken by the victim, and the statements from investigative agency of witness I and the court of the court of the court below also correspond to the statements of the above victims, ② the Defendant confirmed CCTV images taken inside the main point of “D” in the investigative agency, and recognized the fact that the Defendant used the victim E and G to confirm the CCTV images taken inside the main point of “D”, and F also led to the confession of the facts of assaulting the victim E, as described in the facts charged, the Defendant can be sufficiently recognized.

In addition, when comprehensively considering the method and form of the Defendant’s assault, the developments leading up to the assault, and the circumstances before and after the assault, etc., which are acknowledged by the above evidence, the above act of the Defendant occurred in the course of the attacking at the drinking house, and at the same time, it is difficult to view the Defendant’s act as self-defense under the Criminal Act, since the act is a defensive act, and its purpose is legitimate or method is not reasonable socially

Ultimately, the defendant's assertion of mistake and misapprehension of legal principles is without merit.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since the defendant's appeal is without merit. It is so decided as per Disposition.

However, Article 25(1) of the Regulations on Criminal Procedure shall apply.
