1. Basic facts

A. L cooperatives (hereinafter referred to as the “instant association”) are an association established with the purpose of selling a general commercial site of 859mm2 (hereinafter referred to as the “instant site”) supplied to persons subject to livelihood measures as part of living measures related to the business of a free economic zone in the Mountainous district implemented by the Korea Land and Housing Corporation and distributing profits to members through the disposal of the said land.

B. Defendant C is the head of the instant association, and Defendant C is the head of the instant association, and Defendant C is the head of the instant association, and Defendant D, E, F, and net G (hereinafter “Defendant D, etc.”) is the members of the instant association.

C. The Plaintiff entered into a sales contract with Defendant D, etc. to purchase the sales right as listed below (hereinafter each of the instant sales contracts).

Article 7 (Measures for Desertion, Disqualification, and Removal of Membership) (1) No member may withdraw from a cooperative after its establishment until a cooperative enters into a contract for the construction of a site and a contract for the transfer of ownership.

Provided, That where withdrawal is inevitable due to the circumstances of a member, a cooperative shall succeed to the rights and obligations of the member.

Article 8 (Transfer of Land Before Registration of Ownership Transfer) (1) Where a person intends to transfer land supplied by a construction project before registration of ownership transfer, he/she may transfer the whole land supplied only when he/she transfers the whole land, and each share of a partner shall not be individually transferred.
