A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. The Defendant is a person engaging in driving a F car in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from dangerous driving).
On October 15, 2017, the Defendant driven the said car under the influence of alcohol content of 0.167% in blood around 20:04, while driving the said car, and continued the front road of the H restaurant located in G in Gyeonggi-si, Gyeonggi-do, with the one-way hump from the hump of the Do.
At night, the victim I(62) was stopped in order for the victim I to board the ship at night, and thus, the driver of the motor vehicle had a duty of care to prevent the accident in advance by accurately manipulating the steering gear, steering gear, and brakes.
