The judgment below

In light of the records, it is just that the court below maintained the judgment of the court of first instance that acquitted the Defendant on the ground that there is no proof of crime as to the facts charged of this case (excluding the guilty portion) on the grounds as stated in its reasoning, and there is no violation of the rules of evidence as alleged in the grounds

On the other hand, the prosecutor appealed against the guilty portion of the judgment of the court below, but there is no specific reason in the petition of appeal and there is no reason for objection to the petition of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
