The appeal is dismissed.
Reasons
The grounds of appeal are examined.
Since the court of final appeal is a follow-up trial on the judgment of the appellate court, matters not subject to adjudication in the appellate court are not different from the scope of deliberation on the appeal, and thus, it cannot be used as a ground of appeal for reasons other than those that the defendant did not assert as a ground of appeal in the appellate court or that the appellate court is subject to adjudication ex officio (see, e.g., Supreme Court Decision 99Do2831, Mar. 28, 2000). The defendant's assertion that there was an error of misunderstanding of the legal principles as to the facts charged of this case by mistake or misunderstanding of the legal principles as to the facts charged of this case, is asserted in the statement of grounds of appeal submitted after the lapse of the period for
B. In addition, the lower court did not err by exceeding the bounds of the principle of free evaluation in violation of logical and empirical rules, or by misapprehending the legal doctrine on the object of the crime of evading compulsory execution and the urgent escape or legitimate act, contrary to what is alleged in the grounds of appeal.
Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
