Punishment of the crime
Defendant 61 of "2017 High Order 61" was operated as the actual representative of B (State) in Kim Jong-si, and around August 21, 2015, Defendant 2 was Kim Jong-soo, but he was loaned KRW 970 million from the Saemaeul Credit Cooperatives, and was created a collateral security on the factory site, building, machinery, equipment, etc. of the above company and continued to occupy and manage it.
Nevertheless, around October 2015, the Defendant: (a) arbitrarily disposed of more than 260km 12 of the machinery and appliances with factory mortgage at a factory located in the above E; (b) and (c) around that time, concealed the total of 29 types of machinery and appliances, such as the list of crimes in the attached Table.
Accordingly, the defendant, who was the object of the right to collateral security of the victim, concealed factory machinery owned by the above company and obstructed the victim's exercise of rights.
Defendant 2, 710, the top 710, is a person who actually operates the high-gu processing agricultural corporation A in Kim Jong-si, Kim Jong-si.
On August 21, 2015, the Defendant obtained a loan of KRW 885 million from the victims of E-ri Peace Saemaul Saemaul Bank, which was 19,00,000,000,000 from the Simsan-dong 19,00,000.
Nevertheless, around October 2015, the Defendant arbitrarily disposed of 30 species of machinery and appliances (amounting to 883,951,500 won) as stated in the list of concealed machinery and appliances in attached Form from around 201 to December 2015, including the Defendant’s disposal of ice cream machinery and appliances (250km) which are the object of the victim’s factory mortgage without prior notification to the victim.
In this way, the defendant concealed his own property which was the object of another person's right and interfered with the exercise of another person's right.
The defendant 2017 High 834 is the actual representative of the incorporated agricultural company B for the purpose of the agricultural food processing business, etc. in Kim Jong-si.
