Reasons

1. Facts of recognition;

가. C은 2011. 2. 28. 피고와 사이에 D주식회사 소유의 별지1 부동산(이하, ‘이 사건 점포’라 한다) 중 별지2 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉠의 각 점을 순차로 연결한 선내의 (가)부분 약 5㎡(이하, ‘이 사건 부동산’이라 한다)에 관하여 피고에게 차임 월 120만 원, 임대차기간 2011. 2. 28.부터 2013. 2. 27.까지로 정하여 전대하는 내용의 계약(이하, ‘이 사건 전대계약’이라 한다)을 체결하였다.
