1. The defendant is in the case of the auction of real estate rent by the Cheongju District Court C, D, E, F, and G (Dual).
Reasons
Each decision on commencement of auction was rendered under the Cheongju District Court C, Chungcheong Branch C, J, E, F, G (Dual) with respect to the land in this case’s ground reinforced concrete structure, third floor funeral halls, and neighborhood living facilities (hereinafter “the building in this case”) at the time of Chungcheongnamju District Court, from August 26, 2014 to June 23, 2016, with respect to the recognition of the occurrence of the obligation to return unjust enrichment.
(F) In addition to the above voluntary auction case, K Co., Ltd. completed the registration of ownership transfer on June 4, 2013 with respect to the land and building of this case.
① On June 3, 2013, L entered into a mortgage agreement on the instant land and building with K company, and completed the registration of establishment of a mortgage on June 4, 2013, the maximum debt amount of KRW 520,000,000, and the debtor’s K company.
② On June 3, 2013, M entered into a mortgage agreement on the instant land and building with K-liability company, and completed the registration of establishment of a mortgage on June 4, 2013, including the maximum debt amount of KRW 520,000,000,000, and the debtor-liability company, K-based, limited liability company.
③ On June 3, 2013, N entered into a mortgage agreement on the instant land and building with K-liability company, and completed the registration of the establishment of a neighboring mortgage on June 4, 2013, the maximum debt amount of which is KRW 500 million, and the debtor limited liability company.
N on August 14, 2014, transferred 200 million won of the above collateral security to L, and on April 27, 2016, transferred the remainder of 300 million won of the above collateral security toO and completed the registration of transfer of the collateral security at each time.
④ On June 3, 2013, P entered into a mortgage agreement on the instant land and building with K company, and completed the registration of establishment of a mortgage on June 4, 2013, the maximum debt amount of KRW 260,000,000, and the debtor-liability company of K company.
⑤ Q entered into a mortgage-backed contract on the instant land and building with K Co., Ltd. on June 3, 2013, and on June 4, 2013, the maximum debt amount is KRW 200 million, and the debtor limited liability company.
