A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

Around July 2019, the Defendant made a false statement to the victim E at D offices operated by Ulsan-gu, Ulsan-gu, Seoul-gu, stating that “One-day admission ticket for one-day FF golf course is 980,000 won per 1 letter, and is 250,000 won per 24,000 won per 1 letter.”

However, in fact, the Defendant did not have any other way to purchase the admission ticket at the discount of the golf course, and there was no intention or ability to purchase the admission ticket even if the Defendant received money from the victim, as the Defendant was planned to use the money as the pre-payment of the subscription fee for the golf course in advance.

On July 13, 2019, the Defendant, by deceiving the victim, obtained 6 million won as the purchase cost of admission tickets to golf courses from the G account (H) in the name of the Defendant on July 13, 2019 from the victim.

The Defendant stated to the effect that “If a person intends to use a golf course and send the cost of using the golf course, he/she may use the golf course at a discounted price,” the Defendant would pay part of the remainder other than the discounted cost of using the golf course as a commission.”

In June 2019, the Defendant called, “The Defendant, at the above D office, made a promise to use a golf course by phoneing the victim at the above D office, and then sent the cost of using the golf course to another person, because it is possible for another person to make a promise if he/she does not make a promise within a rapid time.”

However, the defendant did not have the intention or ability to use the golf course as necessary for the use of the golf course even if he received the cost of using the golf course from the victim.

Nevertheless, the Defendant, by deceiving the victim as above and deceiving it from the victim, was KRW 13 million with G account under the name of the Defendant around June 20, 2019.
