가. 피고인은 2013. 3. 17. 새벽경 전남 완도군 C에 있는 D 운영의 E 호프집에서 그 곳 호프집에서 다툼이 있다는 신고를 받고 출동한 경찰관인 피해자 F으로부터 “여기서 어떤 일이 있었는지 이야기 해 달라.”는 말을 듣자 격분하여 식당 주인 D과 동료 경찰관이 있는 상태에서 피해자 F에게 “야! 씨발놈아! 짭새가 뭐한디 온거여, 이런 씨발놈아! 저리꺼져”라고 큰소리로 말하여 공연히 피해자를 모욕하였다.

나. 2013. 3. 17. 새벽경 전남 완도군 C에 있는 위 E 호프집 앞 도로에서 경찰관인 피해자 G이 현행범인으로 체포된 피고인을 순찰차량에 태우려고 하자 격분하여 식당 주인 D과 동료 경찰관이 있는 상태에서 위 G에게 “씨발놈아! 너는 또 뭐냐 , 이런 짭새들이 사람잡네, 이 씨발놈아!”라고 큰소리로 말하여 공연히 피해자를 모욕하였다.

다. 피고인은 2013. 3. 17. 새벽경 전남 완도군 H에 있는 I파출소에서 경찰관 J 등 4명이 있는 상태에서 경찰관인 피해자 K에게 “야! 새끼야! 이 씨발놈아! 좆이니 씹이나 알아서 뭐하게, 어이짭새 아저씨! 지미 씨발놈아”라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
