1. Basic facts

A. On August 17, 2007, the Plaintiff obtained the Plaintiff’s doctor’s degree by entering the doctor’s degree course at C University graduate school, sports education, and sports guidance, which the Defendant established and operated, and completing the above course, submitted a doctor’s degree thesis “D” (hereinafter “the instant thesis”) to obtain a doctor’s degree from C University graduate school on August 17, 2007.

B. On March 2012, the instant thesis was published the suspicion that plagiarism was conducted with respect to the Plaintiff, who published at the election of National Assembly members at the press around the end of March, 2012, for the purpose of plagiarism of the doctoral degree thesis “G” in E University Graduate School F (hereinafter “F thesis”).

B. On March 30, 2012, C University graduate schools sent to C University Research Ethics Committee (hereinafter “Research Ethics Committee”) a letter “request for investigation of plagiarism and request for follow-up measures regarding plagiarism of dissertations.” The Research Ethics Committee organized a preliminary investigation committee of the Research Ethics Committee pursuant to Article 18 of the Regulations of the Research Ethics Committee to conduct preliminary investigation into plagiarism.

On April 19, 2012, the Research Ethics Committee held that the preliminary investigation of the instant thesis needs to be conducted on the grounds that the F’s thesis was not presented or presented in the reference literature list despite the conformity of F’s thesis, and that F’s personal consent is irrelevant to plagiarism judgment.

Applicant Accordingly, on May 18, 2012, the Research Ethics Committee organized a full-scale investigation committee consisting of members as indicated below, to investigate the plagiarism of the thesis of this case.

The number of members belonging to the classification of members and the position degrees of the 1st chairperson is the 2nd doctor's degree of law professors of C University Law, the Korean Language Department of C University.
