1. The defendant shall be the plaintiff.

1. Facts of recognition;

A. On June 22, 2010, the Plaintiff entered into a lease agreement with the Defendant on June 22, 2010 with respect to the instant land (hereinafter “instant lease agreement”) with each of the following terms (hereinafter “instant lease agreement”).

B. In addition, the Defendant transferred the instant land from the Plaintiff and planted approximately 150 g of pine trees on the ground.

2. Determination

가. 위 인정사실에 의하면, 이 사건 임대차계약은 2013. 6. 23. 그 임대차기간 만료로 인하여 종료되었으므로 피고는 원고에게 이 사건 토지를 인도하고, 위 임대차기간 만료일 다음날인 2013. 6. 24.부터 이 사건 토지의 인도완료시까지 월 금 83,333원(≒ 1,000,000원 ÷ 12개월. 원고가 구하는 바에 따라 원 미만 버림)의 비율로 계산한 차임 상당 부당이득금을 지급하고, 이 사건 토지 지상에 있는 소나무 일체를 수거할 의무가 있다고 할 것이다.

According to the evidence evidence No. 2, the plaintiff and the defendant at the time of the instant lease agreement, even though they are deemed to have agreed that "it may be extended for two years upon the expiration of the instant lease agreement by consultation if the lessee wishes." Furthermore, the lease period shall be two years after the termination of the instant lease agreement.
