1. Facts of recognition;

가. 위 인정사실에 의하면, 이 사건 임대차계약은 2013. 6. 23. 그 임대차기간 만료로 인하여 종료되었으므로 피고는 원고에게 이 사건 토지를 인도하고, 위 임대차기간 만료일 다음날인 2013. 6. 24.부터 이 사건 토지의 인도완료시까지 월 금 83,333원(≒ 1,000,000원 ÷ 12개월. 원고가 구하는 바에 따라 원 미만 버림)의 비율로 계산한 차임 상당 부당이득금을 지급하고, 이 사건 토지 지상에 있는 소나무 일체를 수거할 의무가 있다고 할 것이다.
