Punishment of the crime

[2017 Highest 1397] The Defendant, from March 3, 2007, managed the Daejeon Pungdong B, which is within the development restriction zone, as the owner of the land and used the forest as farmland by cutting and reclaiming the forest without permission. On December 29, 2015, the Defendant was notified by the head of the Sungdong-gu Office of the corrective order to restore the forest to its original state. On March 11, 2016, the Defendant was issued the corrective order to restore the original state from the head of the Sungdong-gu and was issued the corrective order to the same effect as on July 4, 2016, and was issued the corrective order to the same effect as on August 3, 2016, and was issued the corrective order to the same effect as on September 9, 2016, but did not implement the corrective order.

Accordingly, the defendant did not comply with the corrective order of the competent authority habitually.

[2017 Highest 4571] From March 207, the Defendant was the owner of the Daejeon Pungdong-gu B and C forest located within the development restriction zone, and used it as farmland without permission from the competent authority. On May 2017, the Defendant: (a) performed flat work to use 1,628 square meters of the said C forest as farmland; and (b) changed the form and quality of the land by removing miscellaneous grass at an early stage; (c) around July 2017, the Defendant installed a bitler necessary for agricultural activities at 16 square meters of the said forest land; (d) one bitra, camping fing, three car-types, three water-types, one knit, one knit, and one knit toilet, one knit, and a steel gate and column.

Accordingly, the Defendant changed the form and quality of land without obtaining permission in a development-restricted zone for profit-making purposes, installed structures, and stockpiled goods.
