1. The Defendant’s KRW 39,100,007 as well as 5% per annum from January 10, 2015 to July 14, 2016 to the Plaintiff.
Reasons
1. Facts of recognition;
A. The Plaintiff is a management body comprised of all sectional owners of the aggregate building A (hereinafter “instant building”) with the size of 4 underground floors and 3 floors above ground located in Yeongdeungpo-gu, Young-gu, and the Defendant is a sectional owner who completed each registration of ownership transfer with respect to 2 floors below the above building (Non-201, No. 267.44m2 on November 15, 2013), with respect to 15, 2013 underground floors below the above building (Non-101, No. 2,255.29m2,25.29m2) on February 19, 2014.
B. The ground floor of the instant building is a commercial building; the underground floor is being used as a parking lot; the section for exclusive use of the first, second, and third floors is operated as an off-road parking lot provided for the general use by the sectional owners; the underground floor is used as an attached parking lot for the occupants, users, etc. of the instant building as a common area.
C. From April 2008 to March 2014, the Plaintiff delegated the management of each of the instant buildings to Taewon F&C Co., Ltd., and from March 18, 2014 to Tae Young General Management Co., Ltd., the Plaintiff managed the instant building.
The detailed details of the management expenses and the amount of the management expenses paid by the defendant within the period from July 2014 to December 2, 2014, which the plaintiff calculated and imposed on the defendant according to the ratio of the area of the section for exclusive use of the first and second floors among the buildings in this case, are as follows, and 1% arrears at the time of delinquency in the management expenses (However, less than the cost shall be added.) shall be added.
