Punishment of the crime

[2014 Highest 642] The Defendant, while running a wholesale and retail business of electronic equipment, borrowed money from around 201 to hereinafter “defluencing” in the name of the goods due to a business depression from around 2011, which led to the Defendant’s debt amounting to approximately KRW 400 million in the year 2012, and there was no special property or income under the Defendant’s name and there was no intention to pay for the goods within the fixed period even if the goods were supplied by the victims.

1. Around January 30, 2012, the Defendant, as to the victim D, received KRW 17280,00,00 from the victim, the Defendant acquired KRW 54 Samsung F-80,00 in the market price on the same day, and acquired KRW 54,00 from the victim, the Defendant acquired KRW 1728,00,00 from the victim, for the following reasons: “F” by disposing of the goods supplied by the Defendant under the Defendant’s operation of the Yongsan-gu Seoul E-gu Seoul E-gu Seoul E-S. E-S. (hereinafter “F”); and “I wish to supply the 54 items to the Defendant’s G and H, and pay the amount to the victim by the latest due date.”

2. Around April 23, 2012, the Defendant: (a) purchased an USB and SDH card in total amounting to KRW 3.250,00 won from the victim, on the following grounds: (b) around April 23, 2012, the Defendant: (c) sold the goods supplied by the Defendant to the Defendant 413 Seongdong-gu, Seongdong-gu, Seoul, by disposing of the goods supplied by the victim I to the Defendant; and (d) concealed it to the Defendant that the Defendant would be able to repay the Defendant’s obligations to G and H; and (e) sold the goods supplied to the Defendant; and (e) sold the said goods to other sales offices within 15 days; and (e) obtained the Defendant’s purchase of the USB and SDH card in total amounting to KRW 4270,70,000 from May 2, 2012, as indicated in the attached list of crimes.
