A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. On December 12, 1995, the Defendant, at around 14:00 on December 14, 1995, made the victim D(38 years of age) to obtain a driver's license on the face of 1.1 million won from the victim D(38 years of age).
However, even if the defendant receives money, he did not have the intention or ability to allow the victim to obtain the driver's license.
Nevertheless, the Defendant received 110,000 won in cash as the expenses for issuing driver's license from the victim.
Accordingly, the defendant was given property by deceiving the victim.
2. On December 20, 1995, the Defendant made a false statement to the effect that “Around 13:00 on December 20, 1995, the Defendant would make payment after three months, if he/she lent KRW 10 million to the Plaintiff for a student sports clothes and urban community funeral.”
However, the defendant did not have any special property or income, and even if the defendant borrowed money from the victim, such as the student sports clothes and the absence of money to receive through urban funeral, there was no intention or ability to repay it to the victim.
Nevertheless, the Defendant received 10 million won in cash from the victim on the pretext of a loan from the victim, i.e., the victim.
Accordingly, the defendant was given property by deceiving the victim.
3. On January 6, 1996, the Defendant made a false statement to the effect that the expenses needed to issue a driver’s license to the victim for a cycle of issuing the driver’s license to the victim, as prescribed in paragraph 1, at the restaurant “H” located in the Jeonju City, around 16:00 on January 6, 1996.
However, even if the defendant receives money, he did not have the intention or ability to allow the victim to obtain the driver's license.
Nevertheless, the defendant, however, is the victim's 1.3 million won in cash for the purpose of issuing driver's license from the seat, i.e., 90,000 won in the same month, 90,000 won in the same month, 930,000 won in the same month, and on February 10, 1996.
