1. The Plaintiff’s claim against the primary Defendant for KRW 6 million and damages for delay from November 25, 2015.
Reasons
1. Basic facts
A. The primary Defendant is an autonomous management organization consisting of representatives from each complex of the A Apartment-si, Namyang-si (hereinafter “the apartment of this case”).
B. On November 25, 2011, the primary Defendant entered into a contract on consignment management of multi-family housing with the primary Defendant and its ancillary facilities (public facilities, such as engine rooms, electricity rooms, management offices, senior citizens’ houses, children’s playgrounds, standing trees, and landscape gardening facilities) to entrust the management of welfare facilities, and the main contents are as follows.
Article 2 (Entrustment Management Affairs) (1) The primary defendant shall conduct the management affairs entrusted to the primary defendant as follows:
1. Affairs of the managing bodies under each subparagraph of Article 55 (1) of the Enforcement Decree of the Housing Act (hereinafter referred to as the "Decree") and each subparagraph of Article 25 of the Rules;
2. In addition to the duties referred to in subparagraph 1, matters prescribed by the Housing Act (hereinafter referred to as the "Act"), the Enforcement Decree of the Act, and the Enforcement Rule (hereinafter referred to as the "Decree of the Housing Act") as the duties of the managing body.
Article 3 (Head of Office of Management) (1) The head of the management office that the primary defendant places pursuant to Article 55 (1) of the Act shall be deemed the primary defendant's agent.
C. Preliminary Defendant managed the instant apartment, its ancillary facilities, and welfare facilities from around 2011 to June 2015.
The Plaintiff entered into a contract for the total cost of the instant apartment service and the total cost of cleaning service (hereinafter “instant contract”) by the 10th day of the following month, based on the arrangement of the conjunctive Defendant at around 2012 as the head of the management office of the instant apartment, with B and the service cost of KRW 20,990,00, and the payment period of KRW 10,00. From around that time to June 20, 2015 pursuant to the instant contract.
