피고인은 2019. 6. 24. 07:30경 부산 북구 B아파트 C호 앞 아파트 주차장 내에서 자신이 운행하는 차량의 문을 열수 없도록 고소인 D이 차를 주차하고, 고소인이 짜증을 내면서 차를 제대로 빼주지 않는다는 이유로 약 10분간 “차를 빼면되지 무슨 말이 많냐, 개새끼야, 이런 개자슥아, 미친자슥, 세상살다보니 이런새끼 처음본다”고 욕하는 방법으로 공연히 사람을 모욕하였다.
