1. The Defendant shall pay to the Plaintiff KRW 28,051,240 and the interest rate of KRW 24% per annum from March 10, 2015 to the day of complete payment.

Reasons

1. Facts of recognition;

A. The Plaintiff’s status C Superior Management Committee is a management body comprised of all sectional owners of Gangnam-gu Seoul Metropolitan Government Diplomatic Family (hereinafter “Dward Family”).

The plaintiff was appointed as a management company of DSang around September 2010 from the above management body.

D According to the management rules, the company or the managing director entrusted with the management affairs shall have the authority to claim and receive the management expenses and other charges from each user, etc. (referring to the owner and occupant) and to manage the money.

2. Determination as to the cause of action

A. (i) The Plaintiff’s assertion D is KRW 7,00 per square meter for management expenses for five stories, and the converted area is KRW 501 square meter for 54.7129 square meters for 501 square meters (180.87 square meters) and KRW 502 square meters (398.13 square meters) for unpaid management expenses.

The management expenses unpaid by the defendant are as follows:

(1) From March 201 to January 2014, 201, the amount of KRW 13,404,650 [13,404,650 + 24,48,00 won + 35 months]; (2) subparagraph 502; (35 months from September 201 to January 2014; and 24,448,015 won [843,035 won (=120.437 square x7 square x 7,00 won) x 29 months]; (3) The amount of KRW 37,852,665 [13,404,650 + 24,48,015].

The defendant shall pay to the plaintiff the unpaid management expenses KRW 37,852,665 and delay damages.

⑵ 환산면적과 평당 관리비 ㈎ 을 1~3호증(가지번호 전부 포함)에 의하면, 원고 자신도 501호 54.71평, 502호 120.43평으로 환산해 관리비를 부과하고 있는 사실을 인정할 수 있으므로, 이 사건 관리비 부과의 기준이 되는 환산면적은 위와 같이 보는 것이 옳다.
