The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal that the court below rendered is too unhued and unreasonable.

2. The fact that the Defendant and the victim did not reach an agreement is the sentencing data unfavorable to the Defendant.

However, in full view of all the circumstances that form the sentencing conditions, such as the Defendant’s age, character and conduct, environment, family relationship, circumstances leading to the instant crime, and circumstances leading to the instant crime, the circumstance alleged by the prosecutor is considered.

Even if the sentence of the court below is too unjustifiable, it cannot be deemed unfair.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
