A defendant shall be punished by imprisonment for not less than one year and six months.

An application filed by an applicant for compensation shall be dismissed.

Punishment of the crime

1. 야간주거침입절도 피고인은 2018. 12. 24. 03:00경 부산 금정구 C건물 D호에 있는 피해자 B의 집에서, 피해자의 가족들이 모두 잠을 자고 있는 틈을 타 그곳 외벽의 가스 배관을 타고 올라가 거실 베란다의 시정되어 있지 않은 창문을 통해 방 안까지 침입하여 그곳 화장대 위에 놓여있던 피해자 E 소유의 시가 800,000원 상당의 삼성 갤럭시 A7 휴대폰 1개 및 그 옆방 책상 위에 놓여있던 피해자 B 소유의 시가 300,000원 상당의 듀퐁 검정색 반지갑 1개 및 그 안에 들어있던 현금 228,000원 상당, 신용카드 2매(현대, 경남비씨), 체크카드 1매, 주민등록증 1매, 자동차운전면허증 1매, 보안카드 2매, 로또 복권 2장 등 시가 합계 1,328,000원 상당의 재물을 몰래 가지고 나갔다.

Accordingly, the defendant invadedd the victims' residence at night and stolen the property.

2. On December 25, 2018, the Defendant violated the Fraud and Specialized Credit Financial Business Act: (a) presented the G convenience stores located in Ulsan-gu, Ulsan-gu, to the victim’s name dissipant, stolen B’s GV card, as described in paragraph (1), as indicated in paragraph (1); (b) took place as if the Defendant was a legitimate holder of the said credit card; (c) had the victim pay the said credit card on the credit card terminal; and (d) was issued a tobacco amounting to 4,500 won at the market price.

Accordingly, the defendant deceivings the victim to take the property by deceiving the victim and used the stolen credit card.

3. On December 26, 2018, the Defendant attempted to larceny at night, and around 02:30 on December 26, 2018, the Defendant fleded from the VictimJ’s house located in Ulsan Jung-gu Hegwon I, Ulsan-gu, with the window behind it, and was able to open a beer, while the victim was divingd at the flood, and was locked, with the shoulderer’s sound, with the stringer’s sound, and the stringer’s sound.

Accordingly, the defendant is in the residence of the victim at night.
