A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) is a person who serves as a driver of a passenger car.

On 02. 02. 23:20 on 06. 06. 23:20, the Defendant was under the influence of alcohol with 0.143% of alcohol concentration, and the Defendant was driving the said vehicle, thereby drivinging the said vehicle on a later-way road of the lease coffee 779, Seo-gu, Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu.

At night, in such cases, a person engaged in driving duties of a motor vehicle shall not drive the motor vehicle in a situation where normal driving is difficult due to influence of drinking, and there was a duty of care to accurately and safely manipulate the steering gear and the brake system and prevent the accident from occurring.

Nevertheless, while the Defendant neglected to do so and was under the influence of alcohol as above, the part on the back of the driver’s seat of the victim E (VM 3 years old) driving on the following side of the road was shocked with the front rear part of the Defendant’s vehicle.

As a result, the Defendant, while driving a motor vehicle in a situation where normal driving is difficult due to influence of drinking, was negligent in the course of business as well as in neglecting his/her duty of care as a motor vehicle driver, resulting in an injury to the victim, such as light chills and tensions that require treatment for about two weeks.

2. On June 26, 200, the Defendant has been sentenced to a fine of 2,000,000 won for a violation of the Road Traffic Act (driving) in the Daejeon District Court's Branch of the Daejeon District Court on the 2003th day of June, 203, by a fine of 2,50,000 won for a violation of the Road Traffic Act (driving) in the same court on the 30th day of November 30, 207, and a fine of 3,00,000 won for the same court on the 2,50,000 won for a violation of the Road Traffic Act (driving) in the same court on September 23, 2009.
