1. All of the plaintiff's claims are dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The Plaintiff is an insurance company and Defendant B is the mother of Defendant C.

On April 30, 2016, the Plaintiff concluded an insurance contract (hereinafter “instant insurance contract”) with Defendant B as shown in the separate sheet with Defendant C as the insured and the beneficiary.

B. From birth to birth, Defendant C was diagnosed with the chropolym (red red or cromatic anti-explosion caused by a congenitally occurring maternal mar formation) and was subject to V-bebea (hereinafter “instant procedure”) over 50 times from November 12, 2016 to March 14, 2018, and received KRW 83,774,977 from the Plaintiff.

C. The terms and conditions of the instant insurance contract include the following: (a) diagnosis of not less than a congenital surgery (except for 1,300,000 won per time of operation) is finalized; and (b) the diagnosis of not less than a congenital (except for vegetation symptoms) is conducted for the direct purpose of the treatment; and (c) the examination of not less than a congenital surgery (except for vegetation symptoms, 1,300,000 won per time of operation) is conducted for the direct purpose of the treatment.

한편 이 사건 보험계약의 약관에는 수술이란 병원 또는 의원의 의사, 치과의사의 자격을 가진 자에 의하여 치료가 필요하다고 인정한 경우로서 자택 등에서 치료가 곤란하여 의료 기관에서 의사의 관리 하에 직접적인 치료를 목적으로 의료 기구를 사용하여 생체(生體)에 절단(切斷, 특정부위를 잘라 내는 것), 절제(切除, 특정부위를 잘라 없애는 것) 등의 조작(操作)을 가하는 것을 말하며, 흡인(吸引, 주사기 등으로 빨아들이는 것), 천자(穿刺, 바늘 또는 관을 꽂아 체액조직을 뽑아내거나 약물을 주입하는 것) 등의 조치 및 신경(神經) BLOCK(신경의 차단)은 제외한다고 규정하고 있다.
