Defendant

A shall be punished by a fine of 300,000 won, and by a fine of 1,00,000 won, respectively.

The above fines are imposed by the Defendants.

Punishment of the crime

1. Defendant A is a representative of D’s D key store in Bupyeong-si, Busan, and is a user who run beauty and art business with two full-time workers until August 5, 2018. A.

Wages in violation of the Labor Standards Act shall be paid directly to workers in currency at least once a month on a fixed date.

Nevertheless, the Defendant did not pay KRW 73,355, May 20, 2017, the weekly holiday allowances of KRW 100,936, and the weekly holiday allowances of KRW 322,264, the weekly holiday allowances of KRW 222,264, June 2018, and the weekly holiday allowances of KRW 222,264, the weekly holiday allowances of KRW 222,264, July 2018, and KRW 222,264,755, each month on July 5, 2018, respectively.

B. An employer violating the Minimum Wage Act shall pay workers subject to the minimum wage amount annually wages exceeding the minimum wage amount determined and publicly notified by the Minister of Employment and Labor, and the minimum wage amount from January 1, 2018 to December 31, 2018 is KRW 7,530 per hour.

Nevertheless, the Defendant paid KRW 7,184 in an hourly rate below the minimum wage from January 1, 2018 to May 31, 2018 to E, who worked from May 20, 2017 to August 5, 2018 at the foregoing workplace.

2. Defendant B is a representative of D’s main shop in Bupyeong-si C, and is a user who has run beauty and art business with two full-time workers from August 6, 2018. A.

An employer in violation of the Labor Standards Act and the Guarantee of Workers' Retirement Benefits Act shall, in case where a worker dies or retires, pay the wages, compensations, retirement allowances, and other money and valuables within fourteen days after the cause for such payment occurred.

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the Defendant, at the foregoing workplace from May 20, 2017 to July 18, 2019, between the parties to the agreement, KRW 304,200 and retirement allowance of KRW 3,317,929, in total, from August 2018 to December 2, 2018.
