1. The defendant shall make each of the money recorded in the quotation of the attached appraisal result sheet to the plaintiffs and each of them from February 7, 2013.
Reasons
1. Details of ruling;
(a) Business authorization and public notice - Housing Construction Project Name (AZ): The defendant;
(b) The Central Land Expropriation Committee’s ruling on expropriation on December 14, 2012 - Land subject to expropriation: each parcel of land and its ground obstacles indicated in the parcel number column of the attached appraisal report located in BB in Busan Northern-gu (hereinafter “instant objects subject to expropriation”): The starting date of expropriation: February 6, 2013 - Compensation: The same shall apply to the description in the column of the amount of compensation for expropriation on the attached appraisal report as a result of the appraisal report.
C. The Central Land Tribunal’s ruling on October 24, 2013 - Details of the adjudication: The details of the Plaintiffs’ compensation for losses are as indicated in the column for the amount of compensation for losses as a result of the appraisal in the attached Table attached hereto - An appraisal corporation: a fixed appraisal corporation, a stock company, and a new appraisal corporation in the future (hereinafter “appraisal”)
D. 2. The assertion and judgment
A. Since each of the compensation for the instant objects subject to expropriation as determined by the plaintiffs' objection ruling falls short of the reasonable compensation for losses, the defendant is obligated to pay the plaintiffs the reasonable compensation by the court appraisal, the difference between the compensation amount by the court appraisal and the compensation amount by the objection ruling, and the delay damages therefor.
(b) In a lawsuit concerning the increase or decrease of compensation 1 compensation, there are several appraisal in conflict with the same facts, and in so far as there is no evidence to prove any error in one of them, the court shall either employ any one of the appraisal or make a fact based on only a part of the appraisal.
