1.The judgment of the first instance shall be modified as follows:
Incheon District Court 201j 14324.
Reasons
1. Basic facts
A. The Defendant agreed to make an investment in return for the interest of 4% per month with the Plaintiff (formerly: Co., Ltd. G) running credit business, etc., and paid KRW 50,000,000 each on September 29, 2006, and KRW 50,000,000 on January 29, 2007.
B. From September 29, 2006 to January 13, 2010, the Plaintiff paid to the Defendant KRW 245,866,66,66, totaling KRW 49,86,66, out of the interest and principal as indicated in the following table.
Since then, when the Plaintiff was unable to repay the agreed interest and principal due to business difficulties, C, the representative director of the Plaintiff, prepared and delivered a written statement to the Defendant on January 4, 201, stating, “C, a total amount of KRW 3,00,000,000,000,000,000,000 won, out of 7 January 201 or January 10, 201.”

C. On October 201, the Defendant asserted that “the Defendant set and lent KRW 120,000,000 to the Plaintiff on September 29, 2006 at the rate of KRW 4% per month” against the Plaintiff as the Incheon District Court Decision 201j14324, and the Interest Limitation Act from March 29, 2009 to the date of full payment.
