1. The Defendants are jointly and severally liable to the Plaintiff for KRW 55,042,878 and KRW 40,886,982 from February 4, 2005 to June 13, 2005.

Each fact in the cause of the claim may be acknowledged after considering the overall purport of Gap evidence 1, 2, 3, 5, 6, 7, and Gap evidence 4-1 and 2 among the plaintiff and defendant corporation Gap, and there is no dispute between the plaintiff and defendant Eul.

Therefore, the defendants are jointly and severally liable to pay to the plaintiff the total amount of 55,042,878 won (the remainder 40,886,982 won + the fixed delay damages 14,15,896 won + the fixed delay damages) and 17% per annum from February 4, 2005 to June 13, 2005, which is the date of subrogation, for the remainder of 40,886,982 won from the date of subrogation, as requested by the plaintiff, 20% per annum from the next day to September 30, 2015; and 15% per annum from the next day to the date of payment.

Therefore, the plaintiff's claim against the defendants is justified and it is so decided as per Disposition.
