피고인은 2012. 10. 26. 08:00부터 10:00경 사이에 서울 영등포구 영등포동에 있는 영등포시장 내 피고인이 운영하는 점포 앞에서, 시장 상인 등 40여 명이 듣고 있는 가운데, 평소 시장 내 자리다툼으로 인해 사이가 좋지 않던 피해자 C(여, 53세)에게 ”저 년이 내가 처를 두들겨 패서 도망갔다고 소문낸 년이다. 이 잡년아, 쌍년아, 너가 우리 닭집 기름이 더럽다고 했냐, 일로 와서 봐봐, 깨끗한지 더러운지, 이 쌍년아, 뭐 저런 잡년이 다 있어, 침 튀기니까 절로 가, 이 개년아”라는 등의 욕설을 하고, 피해자 D(여, 47세)에게 “주둥이 닥치고 가라. 너희 년 놈들은 인간이 아니다. 오늘 저녁 니 씹이 센지 내 좆이 센지 오늘 한 번 할래”라는 등의 욕설을 하여 공연히 피해자들을 모욕하였다.
