1. The Defendant’s KRW 5,885,800 with respect to the Plaintiff and KRW 5% per annum from July 24, 2014 to September 21, 2016.

1. 기초사실 피고는 2014. 7. 24. 21:30경 대구 동구 C 소재 원고가 운영하는 ‘D’ 안에서 원고와 임금 문제 등으로 말 다툼을 벌이다가 원고에게 욕설을 하고 가게 밖으로 나가려고 하였고, 이에 원고가 피고의 손을 붙잡자 피고는 원고의 왼쪽 새끼 손가락을 잡아 꺽었다

(hereinafter “instant harmful act.” Accordingly, the Plaintiff suffered approximately five weeks of medical treatment, resulting in the aggravation of the bones of the fifth fingers first, which requires medical treatment.

As above, the Defendant was charged with injury to the Plaintiff by the Daegu District Court 2014 Highest 6278, and the said court sentenced the Plaintiff to six months of imprisonment on July 2, 2015.

On September 4, 2015, the Plaintiff appealed as Daegu District Court 2015No2781, and the said court sentenced the Plaintiff to a suspended sentence of imprisonment for six months.

The above judgment became final and conclusive around that time.

2. Determination:

가. 손해배상책임의 발생 피고가 원고의 왼쪽 새끼 손가락을 잡아 꺽었고, 그로 인하여 원고에게 제5 손가락 첫마디 뼈의 골절상 등을 가하였음은 앞서 본 바와 같은바, 피고는 이 사건 가해행위로 인하여 원고에게 발생한 손해를 배상할 책임이 있다.

B. 1) Medical expenses and medicine expenses from July 26, 2014 to February 24, 2015: Medical expenses from March 13, 2015 to April 9, 2015: KRW 40,000 to June 1, 2015; medical expenses and medicine expenses from May 11, 2015 to June 1, 2015; KRW 185,800 [Grounds for Recognition] A’s evidence 5-1 to 7, A23, and 24-2) were lost income due to the Defendant’s instant harmful act, and the Plaintiff failed to engage in the business for the period of five days (excluding the working days) due to the Defendant’s harmful act during which the period of five days had not elapsed since July 24, 2014 to September 25, 2014;
