A defendant shall be punished by imprisonment for not less than one year and six months.

Seized evidence 4, 6, or 7 shall be confiscated.

Punishment of the crime

[Criminal Power] On December 17, 2015, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Control of Narcotics, Etc. at the Seoul Central District Court on December 17, 2015, and completed the execution of sentence in the Jinju Prison on February 5, 2017.

[2019 Highest 1450] Notwithstanding that the Defendant is not a person handling narcotics, the Defendant dealt with the psychotropic drugs-related Metephacule (tentatively named “philopon”; hereinafter “philopon”) as follows.

1. On February 2019, the Defendant: (a) administered philophones in a manner that puts a large amount of philophones into a single-use injection machine and dilution them into arms on February 1, 2019 in the dwelling plan of the Defendant of Gwanak-gu in Seoul Special Metropolitan City, Gwanak-gu and the Defendant of Seoul Special Metropolitan City on February 2, 2019.

2. On February 28, 2019, the Defendant administered approximately 0.03 gramopon in the same way as the above Defendant’s measure at around 22:00 on February 28, 2019.

[2019 Highest 3852] Notwithstanding that the Defendant is not a person handling narcotics, the Defendant handled psychotropic drugs, as follows:

1. At around 15:00 on February 21, 2019, the Defendant: (a) received cash of KRW 2.50,000 from D4 line E in Jung-gu Seoul Metropolitan Government from F with the purchase price of phiphones from F; (b) delivered the purchase price of phiphones to the sales volume of phiphones; (c) around 16:30 on the same day as of the same day, the Defendant collected the phiphones containing approximately 0.4g of phiphones with the sales volume attached to the above sales volume in the 1st male toilet for the H I floor of Gangnam-gu Seoul Metropolitan Government, Gangnam-gu, Seoul; and (d) collected KRW 2.50,000 in cash on the same page.

Accordingly, the Defendant conspiredd with F to purchase philophones.

2. At around 17:44 February 21, 2019, the Defendant: (a) divided the phiphones purchased as above in the J hotel K of Dongdaemun-gu Seoul Metropolitan Government into two for a single-use injection instrument; (b) injected them with water; and (c) injected them into each of the following:

Accordingly, the Defendant conspireds with F and philophones.
