1. As to KRW 23,409,138 of the Plaintiff (Counterclaim Defendant) and KRW 17,409,138 of the Plaintiff’s KRW 23,409,138, the Defendant (Counterclaim Plaintiff) on October 19, 2018.
Reasons
1. On June 3, 2010, the Plaintiffs entered into a lease agreement with the Defendant, setting the first floor E (hereinafter “instant building”) among the five-story buildings located in Gangnam-gu Seoul Metropolitan Government D, in which the Plaintiffs share with the Defendant, as the lease deposit amount of KRW 4 million, monthly rent of KRW 4.4 million, and the period from July 1, 2010 to June 30, 2012, and deliver the instant building portion to the Defendant after receiving the lease deposit of KRW 4 million, and the Defendant paid KRW 4 million to the previous lessee who operated a car page, and thereafter operated the finite in the instant building portion.
The instant lease agreement was renewed on June 22, 2012 by June 30, 2014, and renewed on June 30, 2014, and the period was concluded on October 8, 2012 between the Plaintiffs and the Defendant, and the Defendant, entered into a lawsuit telephone between the Plaintiffs and the Defendant under this court No. 201630,00, and the protocol of conciliation states that “where the period of lease is extended, the Defendant shall reinstate the instant building portion following the expiration date of the extended contract to the Plaintiffs and order them to restore it to the original state.”
Since June 30, 2014, the instant lease agreement was renewed on June 30, 2014 by June 30, 2016 and renewed on June 30, 2016, and then on June 30, 2016, KRW 5720,000 per month to increase the rent in KRW 440,000 per month, and the management fee was renewed until June 30, 2018.
The Plaintiffs, April 19, 2018, on April 19, 2018, are the Defendant whose term of the instant lease expires.
