A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2019. 10. 15. 22:20경 경기 B에 있는 C에서, 위 노래방 주인이 피고인이 술에 취해 술을 판매하지 않겠다고 하자 이에 화가 나 욕설을 하고 난동을 부리다 112 신고를 받고 출동한 경찰관인 피해자 D(35세)이 피고인에게 귀가를 권유하자 이에 화가 나, 위 노래방 업주 E 등이 있는 가운데 “나 (구치소에서) 나온 지 얼마 안됐어, 야 임마 니가 뭐냐, 개새끼야”라고 욕설을 하고, 계속하여 112 순찰차로 돌아가려는 피해자에게 “계급장 떼고 한번 붙어보자, 니 죽여버리고 싶다”라고 협박하고, 위 경찰관이 순찰차 조수석 쪽 문을 닫으려 하자 손으로 문을 잡아 이를 방해하고, 순찰차 보조석 쪽을 발로 찼다.

Accordingly, the defendant openly insultingd the victim, and interfered with the legitimate execution of duties by the police officer on the dispatch of the 112 reported service.
