A defendant shall be punished by imprisonment for not less than three years and six months.

Punishment of the crime

The defendant is a holder of a car with Clickner and is engaged in driving duties.

1. On October 13, 2012, the Defendant driving the said car at around 23:25, and operated a two-lane road in front of the “Gangyang-gun of the Hanyang-gun” located in the water surface of the Hanyang-gun of the Gangseoyang-gun, both sides of the two-lane road from the inner bank of the inner bank to the two-lane 70km each other at a speed.

At the time, there was a pedestrian crossing at night and at the front of the road, so there was a duty of care to check whether a person engaged in driving of a motor vehicle gets on the road around the crosswalk by reducing the speed and taking a well-rounded room, and to safely drive it.

Nevertheless, under the influence of alcohol, the Defendant failed to find out the victim D (the age of 58) who was on the right side of the same speed and continued to proceed at the same speed, and failed to take necessary measures, such as aiding the victim, even though he was found to have received the victim’s dead part with the front part of the said car, and escaped without taking necessary measures, such as aiding the victim, thereby causing the victim’s death due to the cardiopulmonary suspension between October 13, 2012 and 23:50.

On October 13, 2012, the Defendant was driving the said vehicle without a mandatory insurance without a driver’s license, in the 4km section of approximately 0.078% of blood alcohol level, from the day before and after the house of “F” located at the Seocho-si, Suyang-gun, Suyangyang-gun, the day from October 13, 2012 to the day before the road of the “F” located at the Suyang-gun, Yangyang-gun, Yangyang-gun, the day from October 13, 2012.
