1. The Defendant’s KRW 299,466,966 as well as the Plaintiff’s KRW 20% per annum from October 11, 2014 to September 30, 2015.
Reasons
Basic Facts
The plaintiff is a company engaged in construction business and civil engineering business, and the defendant is a company engaged in real estate leasing business, etc.
The Defendant, as the owner of C forest land 15,057 square meters (hereinafter “instant land”), was promoting a development project to newly build a store and a house for electric power generation in a single unit of the instant land.
(2) The Plaintiff and the Defendant drafted a standard subcontract agreement for construction works (Evidence A; hereinafter referred to as the “instant contract”) with the effect that the Defendant will contract the Plaintiff with the Plaintiff for the creation of a building site and the construction of road packing work for the instant land in the amount of KRW 262,097,68 (Additional Map).
The defendant obtained a construction permit from the public market for the development project of this case and completed the construction report.
The following [Attachment 1] and [Attachment 2] shall be arranged.
(1) On May 21, 2013, the first permission date: the site location of a new building site for a unit of construction; the area of a building 2,655 square meters outside C, and 2,655 square meters outside C, and the first class neighborhood living facilities (retail stores) for the main use of CD on June 17, 2013, the building area of the first class neighborhood living facilities (retail stores) for the first class use of CD 97.11 square meters; the site location of a newly built site for a new building; the area of a building 2,403 square meters outside C, and 403 square meters outside C, and the building area of the first class neighborhood living facilities (retail stores) for the first class 3,000 square meters outside C, 2,552 square meters outside C, and the building area for a building site for the first class 4,000 square meters outside C, 93.75 square meters in building area for the main use of CD 2, and 94.7.
