피고인은 2012. 7. 1. 09:35경 부산시 부산진구 C에 있는 D교회 1층에서 2층으로 올라가는 계단에서 헤어진 아들의 주소를 알아내기 위해 위 교회에 찾아가 E 권사를 상대로 예전에 작성한 자신의 교회 등록카드를 내 놓으라고 시비하는 것을 본 위 교회 장로인 피해자 F(남, 56세)가 시비를 중재하려다 피고인의 반발로 그만 두고 예배를 보기 위해 2층으로 올라가던 중 위 E가 피해자를 가리켜 저 사람이 경찰관이라고 말한 것에 순간 격분하여 “뭐 니가 경찰이야”라고 소리를 치며 피해자에게 다가가 손으로 양복 상의를 잡아당기고 멱살을 잡아 흔든 다음 주먹으로 피해자의 뒷머리를 때려 피해자에게 치료일수 불상의 왼쪽 턱과 목부위가 벌겋게 달아오르게 하는 등의 상해를 가하였다.
