Basic Facts

On March 26, 2010, Defendant A entered into an agency contract with the Plaintiff to operate a H agency in charge of the Plaintiff’s home delivery service for the Busan Jin-gu, D, E, F, G, etc. (hereinafter “instant contract”). Defendant A agreed to operate the said H agency from April 1, 2010 to March 31, 2012, and receive certain fees, etc. from the Plaintiff in return for performing home delivery service for the said area.

In addition, Defendant B and C guaranteed all the obligations of Defendant A to the Plaintiff on the same day.

The main contents of the instant contract are as follows.

6. The defendant shall perform his/her duties in accordance with the guidelines for collection delivery service, the guidelines for transportation of air conditioners, the regulations on payment of agency freight, the collection, delivery, and cargo accident collection, the guidelines for vehicle management and safe driving, etc., which are the annexes to this contract.

Article 3 (1) The name of the defendant's entrusted agency shall be H agency.
