Reasons
Punishment of the crime
1. Violation of the Act on Special Cases concerning the Settlement of Traffic Accidents and the Road Traffic Act and the Defendant is a person engaging in driving a CKa Star Car.
On April 22, 2014, at around 06:15, the Defendant driven the said car and proceeded at about 50 km each hour with two-lanes in front of the Samcheon-dong, Samcheon-si, Samcheon-do along the two-lanes of the Samcheon-do.
At all times, there was an intersection where signal lights are installed, so there was a duty of care for a person engaged in driving a motor vehicle to drive the motor vehicle safely according to good faith.
Nevertheless, the defendant neglected this and proceeded with the stop signal while disregarding that the vehicle progress signal is changed to the stop signal, and the defendant did not avoid the Estamper car driven by the victim D (the age of 67) who was driving from the front of the passenger car of the defendant to the front of the victim's car and did not avoid it, and caused the victim's car to conflict with the signal.
As a result, the Defendant suffered pressure pressure from the victim about 8 weeks of medical treatment due to the above occupational negligence at the same time, and at the same time damaged the above rocketing car amounting to KRW 15 million at the market price.
2. A person who violates the Guarantee of Automobile Accident Compensation Act shall not operate a motor vehicle on the road which is not covered by mandatory insurance, but the Defendant, at around April 22, 2014, operated a car with a car without mandatory insurance, as described in paragraph (1).
